TRANSPORTATION - Open Skies,
Inc. assumes no and expressly disclaims any responsibility for the
performance or non-performance of any transportation carrier's obligations
or duties to you. Where trips include air transportation, tickets
are issued by the cooperating carrier on a space available or conditional
positive space basis, subject to revenue demand, unless otherwise
indicated. Open Skies, Inc. is not responsible for any expenses, damages
or refunds, including ticket refund charges, ground operator charges
and/or hotel charges incurred if traveler is denied boarding or is
bumped due to any reason.
PASSPORTS - All travelers are responsible for having in their possession,
the necessary identification documentation for travel; passports,
visas, or birth certificates accompanied by picture ID.
PRICES AND METHODS OF PAYMENT - All prices, quoted in U.S. dollars,
reflect currency exchange rates at time of publication. Payments must
be made in U.S. dollars. Personal checks, money orders, cashier's
checks, Visa, Mastercard or Discover will be accepted. Personal checks
will not be accepted for payments made less than 35 days prior to
departure. Reservations made less than 35 days prior to departure
are considered late bookings and are subject to late booking fees
to expedite handling.
PRICES DO NOT INCLUDE -Items not mentioned in the itinerary; passport
and visa fees, all gratuities, and items of personal nature, optional
activities and tours. US and foreign airline departure taxes are
not included and are payable in advance. These taxes vary based on
your final destination and airline being used and will be added to
your final total.
ITINERARY AND/OR PRICE CHANGES - All itineraries are planned on the
basis of existing air schedules, interline policies, accommodations
and tour packages at the time of brochure publication and are subject
to change. The prices for transportation, accommodations and tour
package arrangements are subject to change if the existing foreign
exchange rates and airline service charge rates at time of brochure
publication subsequently change. We reserve the right to change the
itinerary in any way deemed necessary.
CANCELLATIONS - Cancellations must be made in writing to Open Skies,
Inc. and will be subject to cancellation penalties. With most Open
Skies, Inc. vacations the minimum penalty for cancellations made more
than 35 days prior to departure will be $200 per person. For cancellations
made 15 to 34 days prior to departure, the minimum penalty will be
$300 per person. Cancellations made less than 15 days prior to departure
are non-refundable. For Australia and Tahiti vacations the minimum
penalty for cancellations made more than 35 days prior to departure
will be $500 per person. For cancellations made 34 -15 days prior
to departure the minimum penalty will be $700 per person. Cancellations
made less than 15 days prior to departure are non-refundable. If you
have combined consecutive trips, the cancellation charges will be
multiplied, based on the number of trips combined and cancelled. No
refunds will be made in the event of "no shows" or trip
interruption for any reason. In addition, on trip changes and/or cancellations,
and/or denied boarding, there may be communication, ticket, and/or
supplier's charges (such as airline, cruise line, ground operator,
hotel, etc.) assessed to you. No refund will be made for unused arrangements
once the trip has commenced. Policies of the particular cruise lines,
ground operators, airlines, transportation carriers, tour operators,
hotels and other accommodations will prevail in addition to the above
stated policies. Cancellations necessary due to acts of nature or
terrorism will not be charged cancellation fees but will be required
to retain full amount of funds paid as an in-house credit to be used
towards another Open Skies vacation within one year from date of cancellation.
Cancellation penalties will not apply to unconfirmable travel requests.
OPEN SKIES, INC. and its employees and agents assume no responsibility
nor liability in connection with any damage or injury you may incur
before, during or after your trip, including but not limited to damages
or injuries sustained (i) in connection with the service of any train,
vessel, carriage, aircraft, motor, or other conveyance which may be
used either wholly or in part, in the performance of its obligations
to you; or (ii) by reason of any defect or mechanical failure in any
vehicle; or (iii) through neglect or default of any company or person
engaged in transporting, housing or otherwise accommodating you. Tour
operators reserve the right to withdraw any or all tours should conditions
warrant, and to decline to accept or retain any passengers as members
of the tour, should conditions warrant. The issued ticket from the
applicable airline or other transportation company shall constitute
the sole contract between the transportation company and the purchaser
of these tours and/or passenger. Airline, rail and steamship fares
quoted are for information purposes only and are subject to change
without notice.
I have read and agree to the terms and conditions of this booking
as stated above including but not limited to cancellation, change,
delivery and no-show charges. I am aware that there may be airport
departure taxes, payable in cash, upon departure from a foreign country.
